Most employees are protected under the Fair Work Work Act 2009 (Cth) (FWA) and the National Employee Standards (NES). Conditions and rights in the FWA and the NES represent an employee’s minimum entitlements which must be provided by an Employer. It’s important to note here that no employer or employee is lawfully able to negotiate around, contract out and relinquish the 10 minimum employment entitlements under the NES.
